Martension Massage & Bodywork, gevestigd te Haarlem, is verantwoordelijk voor de verwerking van persoonsgegevens zoals weergegeven in deze privacyverklaring.

2. Persoonsgegevens die ik verwerk 

Martension verwerkt je persoonsgegevens omdat je gebruik maakt van onze diensten of omdat je deze zelf aan ons verstrekt. Het gaat om: 

  • Voor- en achternaam
  • Adresgegevens (indien nodig voor facturatie)
  • Telefoonnummer (afspraken, sms/WhatsApp Business)
  • E-mailadres (afspraken, facturen, nieuwsbrief)
  • Betaalgegevens (via Mollie/Stripe)
  • Gegevens over afspraken en behandelingen (via Salonized)
  • Eventueel gezondheidsinformatie, uitsluitend indien relevant voor de behandeling en met jouw expliciete toestemming (intake/trajecten).

3. Doeleinden van de verwerking 

Martension verwerkt je persoonsgegevens voor: 

  • Uitvoering van de overeenkomst: het plannen en uitvoeren van massages en trajecten.
  • Administratie en facturatie: voldoen aan wettelijke verplichtingen (belastingwetgeving).
  • Communicatie: bevestigingen, wijzigingen en praktische vragen via e-mail, telefoon, sms of WhatsApp Business.
  • Nieuwsbrief: alleen na jouw expliciete toestemming (opt-in).
  • Analyse en optimalisatie van de website: via Jimdo en Google Analytics.

4. Bewaartermijnen 

  • Therapeutische dossiers: 15 jaar (conform WGBO).
  • Financiële administratie: 7 jaar (fiscale bewaarplicht).
  • Nieuwsbriefgegevens: tot het moment dat je je afmeldt.
  • Overige klantgegevens: maximaal 2 jaar na het laatste contact, tenzij een wettelijke bewaarplicht geldt.

5. Delen van persoonsgegevens met derden 

Martension deelt gegevens uitsluitend met derden die noodzakelijk zijn voor de dienstverlening: 

  • Salonized – afspraken, klantprofielen, intakeformulieren, nieuwsbrief.
  • Mollie/Stripe – veilige online betalingen.
  • Moneybird – administratie en facturatie.
  • Jimdo – websitehosting en webstatistieken.
  • WhatsApp Business (Meta) – alleen indien je zelf contact opneemt of wij je benaderen voor praktische communicatie rondom je afspraak of behandeling.

Met deze partijen zijn verwerkersovereenkomsten gesloten om jouw gegevens te beschermen. 

6. Jimdo en Google Analytics 

Onze website is gebouwd met Jimdo. Jimdo gebruikt o.a. Google Analytics om inzicht te krijgen in het gebruik van de website. Hierbij worden cookies geplaatst op je apparaat. 

  • Google Analytics wordt gebruikt met de extensie _anonymizeIp() zodat IP-adressen anoniem verwerkt worden.

7. WhatsApp Business 

Martension maakt gebruik van WhatsApp Business voor communicatie met cliënten. Je kunt via WhatsApp contact met ons opnemen, of wij kunnen je benaderen voor praktische communicatie die verband houdt met je behandeling of afspraak (bijvoorbeeld een wijziging, bevestiging of aanvullende informatie). Deze berichten zijn uitsluitend servicegericht en niet commercieel. WhatsApp Business wordt aangeboden door Meta; je telefoonnummer en berichtinhoud worden via hun servers verwerkt. 

8. Nieuwsbrief en marketing 

  • Martension verstuurt nieuwsbrieven via Salonized.
  • Je ontvangt deze alleen als je daar expliciet toestemming voor hebt gegeven (opt-in).
  • Je toestemming wordt opgeslagen in je klantprofiel binnen Salonized.
  • Elke nieuwsbrief bevat een afmeldlink.
  • Je telefoonnummer of WhatsApp-nummer wordt uitsluitend gebruikt voor praktische communicatie rondom afspraken, niet voor promotie of marketing tenzij je daar apart toestemming voor hebt gegeven.

9. Jouw rechten 

Op grond van de AVG heb je recht op: 

  • Inzage, correctie en verwijdering van je gegevens.
  • Beperking van de verwerking.
  • Bezwaar tegen verwerking.
  • Intrekking van toestemming (bijv. voor nieuwsbrief).
  • Gegevensoverdraagbaarheid.
  • Indienen van een klacht bij de Autoriteit Persoonsgegevens.

10. Beveiliging van persoonsgegevens 

Martension neemt passende technische en organisatorische maatregelen om misbruik, verlies of onbevoegde toegang tegen te gaan. 

  • Gegevens worden opgeslagen in beveiligde systemen (Salonized, Moneybird, Mollie/Stripe, Jimdo).
  • Toegang is beperkt en beveiligd met wachtwoorden en waar mogelijk tweefactorauthenticatie.
  • Alleen Martension heeft toegang tot cliëntendossiers.

11. Wijzigingen 

Martension kan deze privacyverklaring wijzigen. De meest actuele versie vind je altijd op onze website.

Martension processes your personal data because you use our services or provide this information yourself. We collect: 

  • First and last name
  • Address details (for invoicing if required)
  • Phone number (appointments, SMS/WhatsApp Business)
  • Email address (appointments, invoices, newsletter)
  • Payment details (via Mollie/Stripe)
  • Appointment history and treatment notes (via Salonized)
  • Health information, only if relevant to the treatment and with your explicit consent (intake/therapeutic sessions).

3. Purposes of processing 

Martension processes your personal data for: 

  • Appointments and treatments – to plan and provide massage sessions and therapeutic journeys.
  • Administration and invoicing – to comply with Dutch tax legislation.
  • Communication – confirmations, changes, and practical questions via email, phone, SMS, or WhatsApp Business.
  • Newsletter – only with your explicit consent (opt-in).
  • Website analysis and optimization – through Jimdo and Google Analytics.

4. Data retention 

  • Therapeutic records: 15 years (Dutch healthcare law – WGBO).
  • Financial administration: 7 years (tax law).
  • Newsletter data: until you unsubscribe.
  • Other client data: max. 2 years after last contact, unless a legal obligation applies.

5. Sharing data with third parties 

Martension only shares data with third parties necessary for our services: 

  • Salonized – scheduling, customer profiles, intake forms, newsletter.
  • Mollie/Stripe – secure online payments.
  • Moneybird – accounting and invoicing.
  • Jimdo – website hosting and analytics.
  • WhatsApp Business (Meta) – only if you contact us, or if we contact you for practical communication related to your appointment or treatment.

These parties act as processors under GDPR and are bound by data processing agreements. 

6. Jimdo and Google Analytics 

Our website is hosted on Jimdo, which uses Google Analytics to understand website usage. Cookies are placed on your device for this purpose. 

  • Google Analytics is used with the extension _anonymizeIp() so that IP addresses are processed anonymously.

7. WhatsApp Business 

Martension uses WhatsApp Business to communicate with clients. You may contact us via WhatsApp, or we may contact you for practical communication related to your treatment or appointment (such as a change, confirmation, or additional information). These messages are strictly service-related and not commercial. WhatsApp Business is provided by Meta; your phone number and message content are processed through their servers. 

8. Newsletter and marketing 

  • Martension sends newsletters via Salonized.
  • You will only receive our newsletter if you have explicitly given consent (opt-in).
  • Your consent is stored in your customer profile within Salonized.
  • Each newsletter contains an unsubscribe link.
  • Your phone number or WhatsApp number is used exclusively for practical communication regarding appointments, not for promotional purposes unless you have given separate consent.

9. Your rights under GDPR 

You have the right to: 

  • Access, correct, or delete your data.
  • Restrict processing.
  • Object to processing.
  • Withdraw consent (e.g., for the newsletter).
  • Receive a copy of your data (data portability).
  • File a complaint with the Dutch Data Protection Authority (Autoriteit Persoonsgegevens).

10. Security of personal data 

Martension takes appropriate technical and organizational measures to protect personal data against misuse, loss, or unauthorized access. 

  • Data is stored in secure systems (Salonized, Moneybird, Mollie/Stripe, Jimdo).
  • Access is restricted and protected with passwords and, where possible, two-factor authentication.
  • Only Martension has access to client records.

11. Changes 

Martension may update this Privacy Policy. The most recent version will always be available on our website.
